Terms and Conditions for Early Adopter Program - Stashed
Effective Date: 30/03/2025
By participating in the Early Adopter Program (the "Program") offered by Stashed ("we," "us," "our"), you ("you" or "Participant") agree to be bound by these Terms and Conditions ("Agreement"). Please read this Agreement carefully before participating in the Program. If you do not agree with any of these terms, you should not participate in the Program.
Eligibility
The Program is available only to individuals who are at least 18 years old and have the legal capacity to enter into this Agreement. Stashed reserves the right to verify eligibility and to disqualify any participant at its sole discretion.
Program Participation
By enrolling in the Program, you agree to use the products or services provided by Stashed ("Products") for testing and feedback purposes. You acknowledge that the Products may still be in development and are provided on an “as-is” basis.
You may be required to provide feedback, bug reports, or suggestions related to the functionality and performance of the Products during the Program.
Use of the Products
The Products provided to Early Adopters are for testing purposes only and are not intended for general consumer use. You agree not to use the Products for any commercial purposes or for purposes other than those intended by Stashed.
You agree not to copy, distribute, reverse engineer, or modify the Products in any way.
Confidentiality
You agree to keep any information about the Products, including features, functionalities, and any other details related to the Program, confidential and not disclose it to any third party unless required by law. This confidentiality obligation will continue beyond the termination of your participation in the Program.
Risks and Limitations
You understand and acknowledge that the Products may contain bugs, errors, or other issues that may affect functionality and performance. Stashed does not guarantee the stability, security, or performance of the Products and will not be held liable for any damages or issues that arise from using the Products.
You agree to participate in the Program at your own risk and agree that Stashed is not responsible for any loss of data, hardware, software, or other losses incurred during your use of the Products.
Feedback
By participating in the Program, you grant Stashed a perpetual, royalty-free, worldwide license to use, modify, and incorporate any feedback, suggestions, or ideas you provide into the Products without compensation or further permission.
Termination of Participation
Stashed reserves the right to terminate your participation in the Program at any time and for any reason, including but not limited to your failure to comply with these Terms and Conditions.
You may also choose to discontinue participation in the Program at any time by providing written notice to Stashed.
Intellectual Property
All intellectual property rights to the Products, including any software, designs, trademarks, and other materials provided by Stashed, remain the exclusive property of Stashed. Participation in the Program does not grant you any rights or licenses to the intellectual property of Stashed.
Disclaimers and Limitation of Liability
The Products are provided "as is," and Stashed disclaims all warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
In no event will Stashed be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Program, even if Stashed has been advised of the possibility of such damages.
Privacy
Any personal information collected from you during your participation in the Program will be handled in accordance with Stashed’s Privacy Policy. By participating, you consent to the collection and use of your personal data as described in the Privacy Policy.
Governing Law
This Agreement will be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
Modifications to Terms
Stashed reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to you, and your continued participation in the Program will be subject to the updated terms.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
